Snail Adventure Tours Co., Ltd. – Travel with Purpose, Explore with Respect
These Terms and Conditions ("Agreement") govern the booking and participation in any tour, trip, or service provided by Snail Adventure Tours Co., Ltd. (“we”, “our”, “us” or “the Company”). By booking a tour or service with us, you ("you", “traveler”, or “participant”) acknowledge and agree to be bound by the terms outlined below.
 
A. Booking and Contract Formation
1. Booking Confirmation
A booking is considered confirmed when:
We receive a completed booking form; and
We receive a non-refundable deposit of 30% of the total tour cost.
2. Contract Formation
A contract between you and Snail Adventure Tours is formed only when we issue a written Booking Confirmation.
3. Availability & Acceptance
Bookings are subject to availability. We reserve the right to accept or decline any booking at our discretion.
 
B. Payment Terms
1. Payment Due
Unless otherwise agreed in writing by Snail Adventure Tours, full payment is required at the time of booking to secure your reservation. In select cases, and at our sole discretion, we may allow a deposit payment followed by a final balance payment according to a pre-agreed schedule.
2. Value Added Tax (VAT)
All prices and rates published on our website, brochures, or invoices are inclusive of VAT, unless explicitly stated otherwise.
If your booking does not require full payment at the time of booking and the applicable rate of VAT changes between the booking date and the payment date, we reserve the right to:
Increase your total cost to reflect any higher VAT rate, or
Maintain the original price even if the VAT rate decreases, at our discretion.
3. Promotional and Employee Rates
Any special promotional offers, discounts, or employee rates issued by Snail Adventure Tours are:
Subject to specific terms and conditions, and
Non-transferable, unless we expressly authorize otherwise in writing.
We reserve the right to request valid employee identification and/or photo ID from any guest using an employee promotional rate. Bookings found to be made in violation of these terms may be cancelled without refund, and any payments received may be forfeited.
4. Group Bookings
For group bookings (typically defined as 6 or more travelers on the same itinerary), a separate group booking contract and payment schedule may apply.
Failure to make payments as outlined in the group contract may result in:
Cancellation of the group reservation, and
Forfeiture of any payments already made.

5. Reservation Centre Booking Fee
Bookings made via our reservations center (phone or third-party services) may be subject to a non-refundable service fee. This fee will be disclosed at the time of booking and is in addition to the tour price.
6. Payment Card Requirement
If your booking is not paid in full at the time of reservation, you will be required to:
Provide a valid credit or debit card at the time of booking, and
Authorize us to charge the card in the event of a no-show (see Section C.13) or late cancellation, as outlined in our cancellation policy.
On arrival, you must settle any remaining balance in full by cash or approved payment card prior to check-in or participation. We reserve the right to deny service or participation in any tour until full payment has been received.
 
C. Cancellations, Changes, and No-Show Policy
1. Cancellations by You
All cancellations must be made in writing via email and are effective upon receipt by Snail Adventure Tours. The following cancellation fees apply:
More than 30 days before departure: Loss of deposit
15–30 days before departure: 50% of total tour cost
7–14 days before departure: 75% of total tour cost
Less than 7 days or no-show: 100% of total tour cost
2. Refund Processing
If you are eligible for a refund, we will process it within 30 business days of confirming your cancellation, using the same method of payment originally used.
3. Amendments by You
Requests to change your tour date, itinerary, or traveler details must be submitted in writing and are subject to availability. We reserve the right to charge administrative or price difference fees depending on the nature and timing of the change.
4. Cancellations by Snail Adventure Tours
We reserve the right to cancel or reschedule a tour under the following conditions:
Events of force majeure (e.g., natural disasters, pandemics, political unrest)
Safety concerns or unforeseen operational issues
Failure to meet minimum participant requirements (if applicable)
In the event of cancellation by us, you will be offered:
A full refund, or Transfer of funds to another tour or date, subject to availability
5. Changes by Snail Adventure Tours
While we endeavor to operate tours as advertised, we reserve the right to make changes to the itinerary, accommodations, or transportation when deemed necessary for your safety, comfort, or due to operational reasons. No refunds will be provided for minor itinerary adjustments.
6. No-Show Policy
A "no-show" is defined as failure to arrive for the scheduled tour or activity without prior notice. In the case of a no-show:
100% of the tour cost is forfeited
No refunds or credits will be issued
We recommend contacting us as early as possible if you anticipate any delays or issues with your arrival.
 
D. Travel Insurance, Liability, and Legal Matters
1. Travel Insurance
We strongly recommend that all travelers purchase comprehensive travel insurance that includes coverage for trip cancellation, medical emergencies, personal injury, illness, loss or theft of personal belongings, and travel disruptions.
It is your responsibility to ensure the insurance policy meets your specific needs and covers the entire duration of your tour. Proof of insurance may be requested prior to departure.
2. Health and Medical Conditions
You must inform us in writing of any pre-existing medical conditions, disabilities, or other health concerns that may affect your participation in the tour. We reserve the right to decline participation or require a medical certificate if necessary for your safety or that of the group.
3. Assumption of Risk
By booking with us, you acknowledge that adventure travel involves inherent risks, including but not limited to physical exertion, unpredictable weather, accidents, and interactions with natural environments.
You voluntarily assume all risks associated with your participation and release Snail Adventure Tours and its affiliates from liability for any loss, injury, damage, or expense sustained as a result of your participation, except where such liability is required by law.
4. Limitation of Liability
To the fullest extent permitted by law, Snail Adventure Tours shall not be liable for any:
Indirect, incidental, or consequential losses;
Injury, illness, or death resulting from your own actions, negligence, or failure to follow instructions;
Loss or damage to personal property;
Costs incurred due to delays, weather, acts of God, or force majeure.
5. Third-Party Services
We are not liable for the actions, omissions, or performance of any third-party service providers, including hotels, airlines, transportation operators, or activity providers, even if booked through us. Any claims must be made directly with the third-party provider.
6. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Vietnam.
7. Severability
If any provision of this Agreement is found to be invalid or unenforceable under applicable law, such provision shall be amended or severed from the Agreement without affecting the validity of the remaining provisions.
 
E. Traveler Responsibilities and Code of Conduct
1. Compliance with Local Laws and Customs
Travelers are expected to respect and comply with the laws, customs, and cultural practices of the destination country. Any illegal activity or behavior deemed disrespectful to local communities may result in immediate removal from the tour without refund.
2. Respectful Conduct
Participants must act respectfully toward fellow travelers, local people, tour guides, and staff. Harassment, discrimination, excessive intoxication, or disruptive behavior will not be tolerated. We reserve the right to remove any traveler whose conduct negatively affects the safety, well-being, or enjoyment of others.
3. Environmental Stewardship
We encourage environmentally responsible travel. Travelers should:
Avoid littering or damaging natural or cultural heritage sites
Conserve water and energy where possible
Refrain from purchasing products that exploit wildlife or natural ecosystems
4. Group Participation
Travelers are expected to:
Arrive on time for scheduled activities
Cooperate with group arrangements
Follow the guide’s safety instructions at all times
Failure to comply may lead to exclusion from certain activities or dismissal from the tour.
5. Physical Fitness and Preparation
You are responsible for ensuring that your level of fitness and health is suitable for the tour you are joining. If unsure, please consult your doctor before travel.
6. Documentation
It is your responsibility to carry a valid passport (with required visas) and any necessary travel documents. We are not liable for any loss or inconvenience due to invalid or missing documentation.
7. Feedback and Communication
We welcome constructive feedback before, during, and after the tour. If you experience any issues, please inform your guide or contact our office as soon as possible so we can assist.
 
F. Miscellaneous Provisions and Final Disclaimers
1. Force Majeure
Snail Adventure Tours shall not be held liable or responsible for any failure or delay in performance of its obligations due to events beyond its reasonable control, including but not limited to: acts of God, natural disasters, epidemics or pandemics, war, terrorism, labor strikes, government actions, or travel restrictions. In such cases, we reserve the right to modify, postpone, or cancel affected tours without liability, though we will make every reasonable effort to offer suitable alternatives or credits.
2. Promotional Materials and Media
By participating in our tours, you grant Snail Adventure Tours the right to use photographs, videos, or testimonials in which you may appear for promotional and marketing purposes, both online and offline, without compensation. If you do not wish to appear in any media, please notify us in writing before the start of your tour.
3. Intellectual Property
All content on our website, brochures, and promotional materials—including text, images, logos, and itineraries—is the intellectual property of Snail Adventure Tours and may not be reproduced, used, or distributed without prior written consent.
4. Tour Descriptions and Accuracy
While we make every effort to ensure the accuracy of our promotional materials, website information, and itineraries, occasional errors may occur. We reserve the right to correct inaccuracies or omissions and will inform you of any significant changes affecting your booking as soon as reasonably possible.
5. Entire Agreement
These Terms and Conditions, along with any signed documents and the booking confirmation, constitute the entire agreement between you and Snail Adventure Tours and supersede all prior verbal or written agreements, understandings, or representations.
6. Waiver
The failure of Snail Adventure Tours to enforce any provision of this Agreement shall not be deemed a waiver of our right to enforce such provision in the future.
